Warranty Information
ROBINSON WINDOWS LLC LIMITED WARRANTY AND LIMITATION OF LIABILITY
IMPORTANT NOTICE: Read this entire Limited Warranty and Limitation of Liability (“Limited Warranty”) before purchasing or installing this product. By installing or using this product, you are acknowledging that this Limited Warranty is part of the terms of the sale regardless of whether you purchased the windows or someone purchased the windows on your behalf.
- Warranty Coverage
Robinson Windows LLC (“Company”) warrants that its windows are free from defects in materials and workmanship under normal residential use for a period of one (1) year from the date of original purchase from the Company. This warranty applies only to windows manufactured by Company and installed strictly in accordance with the Company’s installation guidelines. This Limited Warranty is effective for all Company products purchased on or after September 1, 2025.
Subject to the exclusions and limitations set forth herein, the Limited Warranty only covers the following components:
- Vinyl frames and sashes;
- Insulated glass units (IGUs) for fogging and moisture between panes- 3-year warranty but no labor costs included
- Hardware, locks, and balances; and
- Factory-applied finishes.
- Exclusions
This warranty does not cover:
- Damage due to improper storage, handling, installation, finishing, use, modification, or neglect;
- Normal wear and tear, fading within five (5) Delta E units, or discoloration;
- Glass breakage (unless specifically covered by separate agreement);
- Damage from weather, windstorms, earthquakes, disasters, frost, freezing, fire, or acts of God;
- Unauthorized modifications or repairs including unauthorized cleaning solutions used on window frames or glass;
- Finish failure or any other damage due to or arising from defects in the existing structure that the product is installed in or attached to;
- Any damages due to the natural shifting of the structure’s foundation, including, without limitation, inadequate support for the expansion and contraction of the frame;
- Damage resulting from failure to follow Company’s installation and maintenance instructions;
- Minor imperfections in glass that do not affect the product’s structural integrity or significantly obscure normal vision;
- Condensation on the interior or exterior surfaces of the window (which may occur as a natural result of humidity and temperature differentials);
- Products that have not been paid for in full;
- Any damage caused by the use of muriatic acid, which voids all warranties; or
- Labor costs for removal, installation, or reinstallation.
- Limitations of Liability and Remedy
3.1 Limitation on Damages
Company shall not be liable for indirect, incidental, special, or consequential damages of any kind. This includes but is not limited to damage to or loss of other property, loss of use, loss of time, inconvenience, or loss of profits. The total liability of Company under this Limited Warranty shall be limited to and under no circumstances shall it exceed the original purchase price of the affected product.
3.2 Exclusive Remedy
During the warranty period, Company will, at its sole option and discretion, repair or replace any defective component or product covered by this Limited Warranty. For Insulated Glass Units (IGUs), replacement units will be provided at no cost, but installation shall be at the customer’s expense.
Repair and/or replacement of the affected product is the exclusive remedy available to the buyer under this Limited Warranty for any and all claims, losses, injuries, or damages (including claims based on breach of warranty, contract, negligence, tort, strict liability, etc.) resulting from the sale, installation, or use of Company’s products. The choice to repair or replace any covered products is exclusively Company’s decision.
- Claim Procedure
Claims under this Limited Warranty must be submitted in writing to Company—specifically, to Robinson Windows LLC – Warranty Department, [Street Address] and/or [email address]—and must include the following information:
- Claimant’s name, address, and phone number;
- The installation address (if different from Claimant’s address);
- Proof of purchase;
- The approximate date of installation;
- A description of the alleged defect;
- Photographs of the alleged defect.
Company will acknowledge receipt of claim within ten (10) business days and will evaluate the claim within thirty (30) days of receipt. If inspection is required, customer agrees to provide reasonable access to the product for inspection purposes. If the claim is approved, Company will provide the remedy as specified herein within a reasonable time.
- Mandatory Mediation and Waiver of Right to Jury Trial, Class Action Participation, and Venue/Choice of Law
Before pursuing any legal action, all disputes, claims, or controversies arising out of or relating to the Company’s products, including but not limited to claims for product defects, breach of warranty, deceptive trade practice, or service issues, the dispute must first be submitted to mediation subject to the terms below.
5.1 Waiver of Right to Jury Trial and Class Action Participation
You and Company agree to mediate disputes arising out of or relating to your purchase of Company’s products. If mediation fails to resolve the dispute, you and Company further waive the right to try the dispute to a jury. You further waive all rights to proceed as a member or representative of a class action, including class arbitration, regarding disputes arising out of or relating to your Company products.
5.2 Terms of Mediation
Mediation shall be conducted in accordance with the rules of the American Arbitration Association (AAA) or another mutually agreed-upon provider. The mediation shall take place within 90 days after the initial demand for mediation. The mediation—if in-person—shall take place in Dallas, Texas unless both parties agree otherwise. The parties shall split any mediator fees, and each party will bear its own attorneys’ fees and travel costs, if any. If the dispute is not resolved within sixty (60) days of mediation, either party may pursue other remedies permitted by law.
5.3 Governing Law and Venue
This Limited Warranty shall be governed by and construed in accordance with the laws of the State of Texas. In the event any disputes arising out of or relating to your purchase of Company’s products are not resolved at mediation in accordance with Section 5 of this Limited Warranty, you and Company agree that any further suit, proceeding, or claim will proceed in the courts of Dallas County in the State of Texas or the United States District Court for the Northern District of Texas. You and company both irrevocably consent to the jurisdiction and venue of these courts.
5.4 Opting Out Procedure
You may opt out of this mediation agreement and waiver of right to jury trial and class action participation by providing notice to Company no later than ninety (90) calendar days from the date you purchased Company’s products. To opt out, you must send written notice to Robinson Windows LLC – Warranty Department, [Street Address] and/or [email address] declaring your intent to do so. Opting out of your agreement to mediate and/or waive your right to a jury trial or participation in a class action lawsuit will not affect the coverage, if any, provided by this Limited Warranty to your Company products.
- Transferability
This Limited Warranty is non-transferable and applies only to the original purchaser. The Limited Warranty shall terminate upon transfer of ownership of the property wherein the windows are installed or installation of the product in another location.
- Disclaimer of Other Express or Implied Warranties
EXCEPT AS SET FORTH IN THIS LIMITED WARRANTY, COMPANY MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ALL SUCH OTHER WARRANTIES ARE HEREBY DISCLAIMED.
- Entire Agreement – No Amendments Except in Writing
This Limited Warranty constitutes the entire agreement between Company and the original purchaser regarding warranty coverage. No dealer, distributor, or representative of Company has the authority to change or modify this Limited Warranty in any way. Further, this Limited Warranty—which is part of the terms of the sale—may be modified only by written agreement signed by a duly authorized representative of Company.
9. Severability
If any provision of this Limited Warranty is found to be invalid or unenforceable under applicable law, such provision shall be ineffective to the extent of such invalidity or unenforceability without invalidating or rendering unenforceable the remainder of this Limited Warranty.
